Definitions

4lifelonglearning.org hereafter referred to as the “Organization” or “We” or “Site”

Individual who registered with our website hereafter referred to as the “User”

Designer/Assessor refers to User who enrolls for designing or developing a learning media for supporting learning activity, as well as, for reviewing or assessing User’s submission

1. General Terms and Conditions

1.1 User can apply 4lifelonglearning.org online platform by Organization website. User warrants that all registration information submits will be true, accurate, current, legal and complete and related to User itself. The signup stage will be completed when User receives a confirmation message via filled in email from noreply@4lifelonglearning.org 

1.2 User shall maintain the accuracy of provided information and User itself must set Username and Password to access 4lifelonglearning.org with Organization password requirement. User will be responsible for all use of password and account.

1.3 In case that User login to 4lifelonglearning.org by entering Username and password and enter the incorrect password more than the number of times set out by Organization, User will not be able to use the service. In this case, User must follow the procedure specified by Organization. If User does not use the service within the period of time specified by Organization, Organization may suspend the service until User has contacted back and received a confirmation message. In the case of a Username/Password to perform a login is damaged or stolen, Users must notify and/or request to hold a transaction immediately at 4lifesupport@mail.kmutt.ac.th or Support channel. User agrees that any performance of the transaction by using Username/Password before Organization suspends or holds the transaction shall be binding on User and User agrees to be fully responsible.

1.4 User agrees that any actions taken through 4lifelonglearning.org by using Username and Password whether it is used for submission evidence, financial transaction such as payment for earning credentials, miscellaneous query, giving consent, authentication of documents and such actions are in compliance with the procedure or condition by Organization. User agrees with Organization to use the information on his/her action as an original document which is used as evidence in proving that User has taken such actions to be used in legal proceeding in all respects and agrees to be liable for such actions as if it had been carried out by itself. Organization shall assume no liability in any error, defect or damage arising from such acts and User shall not raise such circumstances as a claim or proof in bringing an action against Organization in all respects.

1.5 User can decide to remove User account by notifying Organization in writing in accordance with the procedures and methods set out by Organization.

1.6 User agrees that Organization reserves the right to modify or change the terms and conditions hereof by notifying User by posting a notification of any such change on Organization's website. In cases where such modification or change results in additional expenses or responsibilities for User, User may terminate the service in accordance with the procedure specified herein. 1.7 User agrees that uploaded on content including but not limit to User’s profile, learning evidence submission, learning media and etc. to the Site whether created by User or not, or by Organization on behalf of User, will not exhibit or produce any images, symbols or signs with the following characteristic 

        1.7.1 Copyrighted or being the intellectual property of a third party

        1.7.2 Displayed without the consent of the person appearing in the picture, or unauthorized personal pictures

        1.7.3 Causing social division or expressing political issues

        1.7.4 Inappropriate, impolite, offensive, indecent or obscene images

        1.7.5 Images of actors, musicians, celebrities or athletes, unless they are working for the approved co-branding program

        1.7.6 Detrimental to public order or offensive to culture or religious beliefs

        1.7.7 Associated with gambling, any kind of alcoholic beverage, and/or cigarettes

        1.7.8 The national emblem, as well as pictures or portraits of His Majesty the King, Her Majesty the Queen or the Royal Family members

        1.7.9 Insignias of government agencies, User affirms that User is the owner and/or copyright owner and/or has the legal right of User’s Profile that has been uploaded on Site. If We request additional documents to confirm that User is the copyright owner and/or has the legal right to use User’s Profile, User shall send such documents to Organization upon its request. If User uses any information, images, symbols, trademarks, service marks or any other signs of a third party without their permission or unlawfully, User agrees to be responsible for all damages incurred. Organization is not involved in any way in such wrongdoing. And if it has caused any damage to Organization, User agrees to indemnify Organization in full

1.9 User acknowledges that Intellectual property policy as described under https://www.kmutt.ac.th website which part of this agreement 

1.10 The Terms and conditions of this web site shall be governed by and construed in accordance with the Laws of the Kingdom of Thailand and the court of competent jurisdiction in Thailand will have exclusive jurisdiction in case of dispute.

2. Our Content 

2.1 User shall not perform or try to gain unauthorized access to Site or any networks, servers or computer systems connected to the 4lifelonglearning.org; and/or make for any purpose including error correction, any modifications, adaptations, additions or enhancements to Site or our content, including the modification of the paper or digital copies User may have downloaded. 

2.2 We shall prepare Site and our content with reasonable skill and care; and use appropriate security measures to protect against unauthorized access, modification, disclosure or damage to User’s personal information on our site. We reserve the right by,

        2.2.1 Monitor Site for breaches of these Terms and Conditions;

        2.2.2 Take appropriate legal action against anyone in breach of applicable laws or these Terms and Conditions;

        2.2.3 Remove from Site or otherwise disable all files and content that are excessive in size or are in any way a burden to our systems;

        2.2.4 Manage Site in a manner designed to protect our rights and property and to facilitate the proper functioning of Site.

2.3 We do not guarantee that Site will be secure or free from bugs or viruses. We reserve the right to change, modify, or remove the contents of Site at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of Site without notice at any time.

2.4 We cannot guarantee Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use Site during any downtime or discontinuance of the Site. We are not obliged to maintain and support the Site to supply any corrections, updates, or releases. 

2.5 There may be information on our Site that contains typographical errors, inaccuracies, or omissions that may relate to the Site, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.

3. User Usage

3.1 User agrees to allow Organization to disclose his/her personal information/ Submission evidence to the 3rd party during awarding credential process and publishing to block-chain technology companies that partner with Organization. Their terms can be found at https://www.accredible.com/

3.2 User agrees that evidence submission does not contain plagiarism and is original work and has included appropriate citations and credits in compliance with any applicable academic integrity policy. User acknowledge that if plagiarism or any violations are found, Organization may report this submission or take any other action permitted by Organization regulations.

3.3 User agrees that the earning credential process will be reviewed and assessed within 14 day(s) and will be notified for User’s further actions (if any).

3.4 User agrees that Organization is solely responsible for awarding a submitting credential. In case the 1st submission was denied by Organization, User has 1 more time to resubmit the evidence without charging. Users may dispute the case by clicking the “Support” menu. We reserve the right to make any corrections to price or fee for earning process.

3.5 If User absent during the enrolled course, no refund or certificate will be made for the time missed.

3.6 Site reserves the right to change course dates, course curricula, course schedules, Designer, locations and programs at any time at its discretion. 

3.7 User requires complete all the assessment which is binding with learning outcome which will later be reviewed by Assessor in the reviewing process (If applicable).

3.8 Designer can use our Site for developing learning media under governance of Organization approval process for publishing content available on the Site.

3.9 Organization reserves right for compensation adjustment for Designer

3.10 Designer agrees that the Learning Units (LU) or Micro-Credentials (MC) requires to be reviewed and agreed by Organization before publishing

3.11 User read and acknowledge “Copyright Inspection Instruction”

3.12 User read and acknowledge “Copyright dispute Instruction”
